PLEASE READ THESE TERMS CAREFULLY BEFORE USING NAVAID TOOLS

 

1. ACCEPTANCE OF TERMS

1.1 By accessing, browsing, or using NavAid.dev (“the Website”) and any tools, calculators, or services provided (“the Tools”), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service (“Terms”), including all disclaimers and limitations of liability.

1.2 If you do not agree to these Terms, you must immediately cease using the Website and Tools.

1.3 Continued use of the Website or Tools after any modifications to these Terms constitutes your acceptance of the modified Terms.

1.4 You represent and warrant that you are legally capable of entering into binding contracts and are at least 18 years of age or the age of majority in your jurisdiction.

 

2. SERVICE DESCRIPTION

2.1 NavAid provides free, browser-based navigation training tools and flight calculators for general aviation pilots, including but not limited to:

  • GPS-based ILS, VOR, and NDB approach trainers
  • Fuel consumption trackers
  • Wind and navigation calculators
  • TCAS traffic awareness tools
  • Flight planning aids

2.2 All Tools are provided solely for training, education, and practice purposes.

2.3 NavAid reserves the right to modify, suspend, discontinue, or restrict access to any Tool at any time without notice or liability.

 

3. CRITICAL DISCLAIMER – NOT FOR OPERATIONAL USE

3.1 TRAINING TOOLS ONLY

WARNING: These Tools are NOT certified, approved, or authorized by any aviation authority (including but not limited to FAA, EASA, CASA, Transport Canada, or any national or international aviation regulatory body) for operational flight use.

3.2 PROHIBITED USES

YOU MUST NEVER use these Tools for:

  • Primary navigation during flight operations
  • Collision avoidance or traffic separation
  • Safety-critical decision making
  • Instrument approaches in actual or simulated IMC
  • Meeting regulatory requirements for approved navigation equipment
  • Any operational flight situation where safety depends on accuracy
  • Certification, examination, or check-ride purposes

3.3 WHAT THESE TOOLS ARE NOT

These Tools are NOT:

  • Certified aviation equipment or avionics
  • Tested or approved to aviation safety standards
  • Substitutes for approved navigation instruments
  • Replacements for certified GNSS, VOR, NDB, ILS, or other navigation systems
  • Guaranteed to be accurate, reliable, or fit for any purpose
  • Suitable for use as primary or backup navigation sources

3.4 REGULATORY COMPLIANCE

You are solely responsible for compliance with all applicable aviation regulations in your jurisdiction, including but not limited to requirements for approved navigation equipment, charts, and flight planning materials.

 

4. DEVICE-DEPENDENT PERFORMANCE & LIMITATIONS

4.1 DEVICE VARIABILITY

Tool performance, accuracy, and reliability are entirely dependent on your mobile device’s capabilities, including:

  • GPS receiver quality, accuracy, and signal strength
  • Compass calibration and magnetic sensor precision
  • Gyroscope and accelerometer accuracy
  • Battery level and power management
  • Processing power and available memory
  • Operating system version and configuration
  • Network connectivity and data availability
  • Environmental conditions (weather, terrain, interference)

4.2 NO PERFORMANCE GUARANTEE

NavAid cannot and does not guarantee:

  • Consistent performance across different devices or conditions
  • Accuracy of GPS position, heading, or altitude information
  • Real-time functionality or data availability
  • Tool operation during critical flight phases
  • Compatibility with all devices or operating systems

4.3 GPS & SENSOR LIMITATIONS

GPS and device sensors are subject to:

  • Signal loss, degradation, or interference
  • Multi-path errors and atmospheric effects
  • Magnetic deviation and local magnetic anomalies
  • Calibration drift and sensor errors
  • Software and firmware limitations

You acknowledge these limitations and accept all risks associated with device-dependent performance.

 

5. USER RESPONSIBILITIES & WARRANTIES

5.1 PILOT IN COMMAND OBLIGATIONS

You acknowledge and agree that as pilot in command (or student pilot under supervision), you are solely and exclusively responsible for:

  • All flight safety and navigation decisions
  • Verifying all calculations and information through approved methods
  • Using only certified avionics for actual flight operations
  • Maintaining situational awareness through approved means
  • Following all applicable aviation regulations and procedures
  • Understanding and accepting your device’s limitations
  • Ensuring adequate backup navigation capability
  • Pre-flight planning using certified sources

5.2 USER WARRANTIES

By using these Tools, you represent and warrant that you:

  • Hold appropriate pilot certificates, licenses, or are training under supervision
  • Are legally capable of entering into binding agreements
  • Will use Tools for training and educational purposes only
  • Will NOT rely on Tools for operational navigation or safety-critical decisions
  • Understand aviation regulations applicable to your operations
  • Have adequate knowledge to interpret Tool outputs correctly
  • Will verify all information against approved sources
  • Accept full responsibility for consequences of Tool use or misuse
  • Will immediately discontinue use if Tools malfunction or produce questionable results

5.3 PROHIBITED CONDUCT

You agree NOT to:

  • Use Tools in violation of aviation regulations
  • Rely on Tools as primary or backup navigation equipment
  • Use Tools for commercial operations without appropriate licensing
  • Copy, modify, reverse-engineer, or create derivative works
  • Remove, alter, or obscure copyright notices or disclaimers
  • Attempt to hack, disrupt, or compromise Website security
  • Use Tools in any manner that could endanger safety
  • Redistribute, resell, or sublicense Tools without authorization

 

6. DEVICE & POWER REQUIREMENTS

6.1 USER EQUIPMENT OBLIGATIONS

You are solely responsible for:

  • Providing a functional, compatible mobile device or tablet
  • Ensuring adequate battery power or external power source for intended use duration
  • Maintaining device in proper working condition
  • Installing required updates and maintaining software
  • Ensuring GPS and sensor functionality and calibration
  • Securing device against loss, theft, or unauthorized access
  • Backing up any data entered into Tools
  • Having alternate approved navigation means available

6.2 POWER & FUNCTIONALITY

NavAid is NOT liable for:

  • Device battery depletion during use
  • Device malfunction, freezing, or crashing
  • Loss of GPS signal or sensor functionality
  • Screen dimming, overheating, or visibility issues
  • Operating system conflicts or compatibility issues
  • Data loss or corruption

 

7. HEALTH & SAFETY WARNINGS

7.1 SCREEN USE & EYE STRAIN

Prolonged use of mobile device screens may cause:

  • Eye strain, fatigue, or discomfort
  • Headaches or vision disturbances
  • Neck, shoulder, or back strain
  • Reduced situational awareness

You must take regular breaks and maintain proper ergonomics during extended use.

7.2 PHOTOSENSITIVE SEIZURES

A small percentage of people may experience seizures or blackouts when exposed to:

  • Flashing lights or patterns
  • Rapid screen transitions or movements
  • Certain visual stimuli

Symptoms may include:

  • Dizziness or lightheadedness
  • Altered or blurred vision
  • Eye or facial twitching
  • Loss of awareness or consciousness
  • Convulsions or involuntary movements

If you or anyone in your family has a history of seizures or epilepsy, consult a physician before using these Tools.

7.3 IMMEDIATE CESSATION

If you experience any of the following while using Tools, STOP IMMEDIATELY and seek medical attention if symptoms persist:

  • Dizziness, nausea, or disorientation
  • Vision changes or eye discomfort
  • Numbness or tingling
  • Loss of awareness or altered consciousness
  • Any unusual physical or mental symptoms

7.4 DISTRACTION RISK

Use of electronic devices during flight operations creates distraction risk. You must:

  • Maintain primary focus on aircraft operation and traffic scanning
  • Not allow Tools to interfere with crew resource management
  • Brief passengers on Tool use and safety considerations
  • Discontinue use if it compromises safety or situational awareness

 

8. NO WARRANTIES – “AS IS” PROVISION

8.1 DISCLAIMER OF ALL WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NavAid and its Tools are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, either express or implied.

8.2 SPECIFICALLY DISCLAIMED WARRANTIES

NavAid EXPRESSLY DISCLAIMS all warranties including but not limited to:

  • Merchantability – fitness for any particular purpose
  • Non-infringement – freedom from third-party rights violations
  • Accuracy or reliability – correctness of calculations, data, or outputs
  • Fitness for purpose – suitability for training or any other use
  • Uninterrupted operation – continuous availability or functionality
  • Error-free operation – freedom from bugs, defects, or malfunctions
  • Security – protection against viruses, hacking, or data loss
  • Compatibility – operation on all devices or configurations
  • Title – ownership or legal right to use
  • Quiet enjoyment – undisturbed use

8.3 NO GUARANTEE OF ACCURACY

NavAid makes NO representations or guarantees regarding:

  • Accuracy of GPS positions, headings, or altitudes
  • Correctness of navigation calculations or flight planning
  • Currency or completeness of any data
  • Reliability of device sensors or measurements
  • Performance under any specific conditions

8.4 ERRORS & OMISSIONS

The Website and Tools may contain:

  • Inaccuracies, errors, or omissions in code, calculations, or data
  • Bugs, defects, or malfunctions in software
  • Outdated information or procedures
  • Typographical or technical errors

NavAid has no obligation to correct errors or maintain accuracy.

 

9. LIMITATION OF LIABILITY

9.1 MAXIMUM LIABILITY EXCLUSION

TO THE FULLEST EXTENT PERMITTED BY LAW, NavAid, its owners, operators, developers, contributors, affiliates, agents, and representatives shall have ZERO LIABILITY and NO RESPONSIBILITY for any damages, losses, injuries, or consequences of any kind arising from or related to:

  • Use, misuse, or inability to use the Website or Tools
  • Reliance on any information, data, or calculations provided
  • Device malfunction, GPS errors, or sensor inaccuracies
  • Software bugs, errors, omissions, or malfunctions
  • Service interruptions, delays, or unavailability
  • Data loss, corruption, or unauthorized access
  • Network failures or connectivity issues
  • Third-party content, data, or services

9.2 TYPES OF DAMAGES EXCLUDED

NavAid shall NOT be liable for any:

Direct Damages:

  • Property damage or destruction
  • Aircraft damage or total loss
  • Equipment damage or loss
  • Medical expenses
  • Repair or replacement costs

Indirect & Consequential Damages:

  • Loss of life, injury, or disability (physical or mental)
  • Pain and suffering
  • Loss of profits, revenue, or business
  • Loss of use or opportunity
  • Flight delays or cancellations
  • Regulatory violations, fines, or penalties
  • Certificate suspension or revocation
  • Insurance claims or premium increases
  • Emotional distress or mental anguish
  • Reputational harm

Special & Punitive Damages:

  • Exemplary or punitive damages
  • Statutory damages
  • Treble damages

9.3 CAUSES OF ACTION

This limitation applies regardless of the legal theory, including but not limited to:

  • Negligence (simple, gross, or criminal)
  • Strict liability or product liability
  • Breach of contract or warranty
  • Misrepresentation or fraud
  • Statutory violations
  • Any other tort or legal theory

9.4 KNOWLEDGE OF POSSIBILITY

This limitation applies EVEN IF NavAid has been advised of the possibility of such damages.

9.5 MAXIMUM LIABILITY CAP

In jurisdictions where liability cannot be fully excluded, NavAid’s total aggregate liability for all claims shall not exceed USD $0.00 (zero dollars) or the amount you paid to NavAid (which is $0 for free services), whichever is less.

 

10. INDEMNIFICATION

10.1 USER INDEMNITY OBLIGATION

You AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS NavAid, its owners, operators, developers, contributors, affiliates, partners, agents, and representatives from and against:

Any and all:

  • Claims, actions, suits, proceedings, or demands
  • Damages, losses, liabilities, or costs
  • Legal fees, expenses, and court costs
  • Regulatory fines or penalties
  • Settlements or judgments

Arising from or related to:

  • Your use or misuse of the Website or Tools
  • Any flight operations where Tools were used or consulted
  • Device malfunction or GPS inaccuracy
  • Your violation of these Terms
  • Your violation of aviation regulations
  • Infringement of third-party rights
  • Your negligence or misconduct
  • Any incident, accident, or safety event
  • Claims by passengers, third parties, or authorities
  • Property damage or personal injury

10.2 DEFENSE OBLIGATION

You agree to cooperate fully in the defense of any claims and to assume control of defense and settlement at your expense if NavAid requests.

10.3 NO SETTLEMENT WITHOUT CONSENT

You may not settle any claim that imposes obligations or liability on NavAid without NavAid’s prior written consent.

 

11. INTELLECTUAL PROPERTY RIGHTS

11.1 OWNERSHIP

All Tools, Website content, software, code, algorithms, designs, graphics, user interfaces, trademarks, logos, and documentation are the exclusive property of NavAid and are protected by:

  • Copyright laws (international and domestic)
  • Trademark laws
  • Trade secret laws
  • Patent laws (where applicable)
  • Other intellectual property laws

11.2 LIMITED LICENSE

Subject to your compliance with these Terms, NavAid grants you a limited, non-exclusive, non-transferable, revocable license to:

  • Access and use the Website and Tools
  • For personal, non-commercial training purposes only
  • In accordance with these Terms

11.3 PROHIBITED ACTIONS

You may NOT:

  • Copy, reproduce, or duplicate any Tools or code
  • Reverse-engineer, decompile, or disassemble software
  • Modify, adapt, or create derivative works
  • Remove, alter, or obscure copyright notices, watermarks, or disclaimers
  • Extract, scrape, or harvest data or code
  • Use automated systems to access or download content
  • Redistribute, sell, rent, lease, or sublicense Tools
  • Use Tools for commercial purposes without licensing
  • Frame or mirror the Website
  • Create databases of Tool outputs

11.4 ENFORCEMENT

Violation of intellectual property rights may result in:

  • Immediate termination of access
  • Legal action for damages and injunctive relief
  • Recovery of attorney fees and costs
  • Criminal prosecution where applicable

11.5 DMCA COMPLIANCE

NavAid respects intellectual property rights. To report copyright infringement, contact support@navaid.dev with detailed information.

 

12. THIRD-PARTY DATA & SERVICES

12.1 THIRD-PARTY DEPENDENCIES

Tools may utilize data, maps, or services from third parties including but not limited to:

  • GPS satellite systems (U.S. GPS, GLONASS, Galileo, BeiDou)
  • Mapping services (OpenStreetMap, Leaflet)
  • Device operating systems (iOS, Android)
  • Browser technologies
  • Cloud services and CDNs

12.2 NO CONTROL OR RESPONSIBILITY

NavAid does NOT:

  • Control or guarantee availability of third-party services
  • Verify accuracy or completeness of third-party data
  • Assume liability for third-party errors or failures
  • Warrant compatibility with third-party systems
  • Provide support for third-party services

12.3 THIRD-PARTY TERMS

Use of third-party services may be subject to additional terms. You are responsible for compliance with all applicable third-party terms and conditions.

12.4 GPS SYSTEM LIMITATIONS

GPS systems are:

  • Operated by governmental entities (primarily U.S. Department of Defense)
  • Subject to service degradation or termination without notice
  • Affected by atmospheric conditions, terrain, and interference
  • Not guaranteed for accuracy or availability

 

13. MODIFICATIONS & UPDATES

13.1 RIGHT TO MODIFY

NavAid reserves the absolute and unlimited right to:

  • Modify, update, or discontinue any Tool at any time
  • Change features, functionality, or user interface
  • Alter calculations, algorithms, or methodologies
  • Update these Terms without prior notice
  • Suspend or terminate services temporarily or permanently
  • Impose usage restrictions or requirements

13.2 NO OBLIGATION TO NOTIFY

NavAid has NO obligation to:

  • Provide advance notice of changes
  • Explain reasons for modifications
  • Maintain backward compatibility
  • Preserve historical data or functionality
  • Continue offering any particular Tool

13.3 ACCEPTANCE OF CHANGES

Continued use after modifications constitutes acceptance of changes. You are responsible for reviewing Terms regularly.

13.4 NO GUARANTEE OF AVAILABILITY

NavAid makes no guarantee that:

  • Tools will always be available or accessible
  • Features will remain unchanged
  • Service will be uninterrupted or error-free
  • Updates will not introduce new issues

 

14. TERMINATION & SUSPENSION

14.1 TERMINATION BY NAVAID

NavAid may immediately terminate or suspend your access without notice if:

  • You violate any provision of these Terms
  • You engage in prohibited conduct
  • You misuse Tools in unsafe manner
  • You attempt to reverse-engineer or copy Tools
  • You infringe intellectual property rights
  • NavAid suspects fraudulent or harmful activity
  • Required by law or regulatory authority
  • NavAid decides to discontinue services

14.2 TERMINATION BY USER

You may terminate use at any time by ceasing to access the Website and Tools.

14.3 EFFECT OF TERMINATION

Upon termination:

  • Your license to use Tools immediately ceases
  • You must discontinue all use of Website and Tools
  • All disclaimers and limitations of liability survive
  • NavAid has no obligation to retain your data
  • No refunds are provided (services are free)

14.4 SURVIVAL

The following provisions survive termination:

  • Sections 8 (No Warranties), 9 (Limitation of Liability), 10 (Indemnification), 11 (Intellectual Property), and 20 (Governing Law)

 

15. FORCE MAJEURE

15.1 EVENTS BEYOND CONTROL

NavAid shall NOT be liable for failure or delay in performance due to events beyond reasonable control, including but not limited to:

Natural Events:

  • Earthquakes, floods, tsunamis, hurricanes, tornadoes
  • Volcanic eruptions, wildfires, or extreme weather
  • Pandemics, epidemics, or public health emergencies

Technical Events:

  • GPS system failures, degradation, or selective availability
  • Internet outages or network failures
  • Power outages or electrical grid failures
  • Cyber attacks, hacking, or malware
  • Server failures or data center issues
  • Software vulnerabilities or zero-day exploits

Human Events:

  • Wars, terrorism, or acts of violence
  • Government actions, regulations, or restrictions
  • Labor strikes or work stoppages
  • Riots, civil unrest, or insurrection

Other Events:

  • Acts of God or deity
  • Any other cause beyond NavAid’s reasonable control

15.2 PERFORMANCE EXCUSED

During force majeure events, NavAid’s obligations are suspended without liability.

 

16. TRAINING & EDUCATIONAL CONTEXT

16.1 PURPOSE OF TOOLS

These Tools are designed SOLELY to:

  • Supplement ground and flight training under supervision
  • Provide practice with navigation concepts and procedures
  • Build familiarity with instrument approaches and calculations
  • Enhance understanding of aviation principles
  • Allow repetitive practice in non-critical environment

16.2 NOT A SUBSTITUTE FOR

Tools CANNOT and DO NOT replace:

  • Formal flight instruction from certified instructors
  • Approved training programs or curricula
  • Certified flight training devices or simulators
  • Official aviation publications or charts
  • Practical flight experience
  • Sound pilot judgment and airmanship

16.3 NO CERTIFICATION OR ENDORSEMENT

Use of Tools does NOT:

  • Satisfy any flight training requirements
  • Count toward pilot certification hour requirements
  • Constitute official instruction or endorsement
  • Qualify as approved ground school or training
  • Provide any regulatory credit or recognition

 

17. NO PROFESSIONAL ADVICE

17.1 NOT PROFESSIONAL SERVICES

NavAid and its Tools do NOT constitute:

  • Professional aviation consulting or advice
  • Flight instruction or training services
  • Aircraft maintenance or technical guidance
  • Legal, regulatory, or compliance advice
  • Medical or health advice
  • Any professional services requiring licensing or certification

17.2 CONSULT QUALIFIED PROFESSIONALS

For professional advice, consult:

  • Certificated flight instructors (CFI, CFII, MEI)
  • Aviation mechanics (A&P, IA)
  • Aviation attorneys or consultants
  • Aviation medical examiners (AME)
  • Regulatory authorities (FAA, CASA, EASA, Transport Canada)

 

18. DATA COLLECTION & PRIVACY

18.1 MINIMAL DATA COLLECTION

NavAid collects minimal data as described in our separate Privacy Policy, including:

  • Anonymous usage analytics
  • Device type and browser information
  • General location (city/country level)

18.2 GPS & SENSOR DATA

GPS position, heading, and sensor data are:

  • Processed locally on your device
  • NOT transmitted to NavAid servers
  • NOT stored or retained by NavAid
  • Used only for real-time Tool functionality

18.3 PRIVACY POLICY

Data collection and use are governed by our Privacy Policy, incorporated by reference into these Terms.

 

19. MISCELLANEOUS PROVISIONS

19.1 ENTIRE AGREEMENT

These Terms, together with the Privacy Policy, constitute the entire agreement between you and NavAid regarding use of the Website and Tools. No other agreements, representations, warranties, or promises (oral or written) have any effect.

19.2 SEVERABILITY

If any provision is found invalid, illegal, or unenforceable, the remaining provisions remain in full force. Invalid provisions shall be modified to reflect original intent to the maximum extent possible.

19.3 WAIVER

NavAid’s failure to enforce any provision does not constitute waiver of that provision or any other provision. No waiver is effective unless in writing and signed by NavAid.

19.4 NO ASSIGNMENT

You may not assign, transfer, or delegate your rights or obligations under these Terms. NavAid may freely assign these Terms without restriction.

19.5 HEADINGS

Section headings are for convenience only and do not affect interpretation.

19.6 INDEPENDENT CONTRACTORS

Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship.

19.7 LANGUAGE

In case of translation, the English version prevails in any dispute.

 

20. GOVERNING LAW & DISPUTE RESOLUTION

20.1 GOVERNING LAW

These Terms are governed by and construed in accordance with the laws of Victoria, Australia, without regard to conflict of law principles.

20.2 JURISDICTION

Any legal action or proceeding arising from these Terms shall be brought exclusively in the courts of Victoria, Australia. You consent to personal jurisdiction and venue in such courts.

20.3 INTERNATIONAL USERS

If you access the Website from outside Australia, you do so at your own risk and are responsible for compliance with local laws. These Terms apply regardless of your location.

20.4 CONSUMER PROTECTION LAWS

20.4.1 Australian Consumer Law (ACL)

For Australian users: The Australian Consumer Law provides consumer guarantees that cannot be excluded. To the extent permitted by ACL:

  • Our liability is limited to re-supply of services or payment of re-supply costs (at our option)
  • We exclude all other warranties and conditions
  • We are not liable for indirect, consequential, or economic loss

20.4.2 European Union Users

For EU users: You may have rights under EU consumer protection directives. Nothing in these Terms affects your statutory rights that cannot be waived by contract.

20.4.3 United States Users

For U.S. users: Some states do not allow exclusion of implied warranties or limitation of liability for incidental or consequential damages. In such jurisdictions, limitations may not fully apply.

20.4.4 Canadian Users

For Canadian users: Provincial consumer protection laws may provide additional rights. These Terms do not affect rights that cannot be waived by agreement.

20.4.5 Other Jurisdictions

For users in other countries: Local consumer protection, product liability, or aviation laws may provide additional rights or restrictions. You are responsible for understanding and complying with applicable local laws.

20.5 MAXIMUM PROTECTION

To the extent any jurisdiction restricts disclaimers or limitations:

  • Limitations apply to the maximum extent permitted by law
  • Any unenforceable provisions are modified to maximum enforceable extent
  • All other provisions remain fully enforceable

 

21. AVIATION REGULATION COMPLIANCE

21.1 PILOT OBLIGATIONS

You acknowledge and agree that:

  • You are solely responsible for compliance with aviation regulations in your jurisdiction
  • These Tools do NOT satisfy regulatory requirements for approved equipment
  • Use of Tools does not exempt you from any regulatory obligations
  • You must maintain all required certifications, licenses, and currency
  • Regulatory authorities have not approved or endorsed these Tools

21.2 JURISDICTION-SPECIFIC REGULATIONS

Users are subject to regulations including but not limited to:

  • United States: FAA regulations (14 CFR)
  • European Union: EASA regulations
  • Australia: CASA regulations (CASR)
  • Canada: Transport Canada regulations (CARs)
  • United Kingdom: CAA regulations
  • Other: Local civil aviation authority regulations

21.3 NO REGULATORY APPROVAL

NavAid has NOT obtained and does NOT claim:

  • FAA approval or certification (TSO, STC, PMA)
  • EASA certification or approval
  • CASA approval under CASR Part 175 or any other regulation
  • Any other national or international aviation authority approval

 

22. FINAL ACKNOWLEDGMENTS

22.1 INFORMED CONSENT

By using these Tools, you acknowledge that you have:

  • Read and understood these Terms in their entirety
  • Had opportunity to seek legal advice if desired
